Demolition, Defective Machines & Compressed Gas Accidents

Demolition involves the breaking down of structures to clear the way for new uses of land. Workers involved in demolition must work under difficult conditions. The buildings they seek to bring down are often run down and structurally unsound.  In addition, the equipment they use has to provide the force to bring down the largest structures and the most powerful materials. This equipment, which often includes dynamite, wrecking balls, and cranes, can subject a worker to a large number of hazards that can result in injury or death.

Because demolition is so inherently dangerous, employers face a huge burden to ensure that their workers are provided with every possible safeguard. State, federal, and local regulations require that employers inspect the job site for any possible hazard. If any are found, employers must remedy them until the worksite is as safe as possible. Workers must be given proper safety gear and properly maintained equipment.

Sadly, regardless of the amount of regulation, many thousands of people are injured or killed in demolition accidents each year from falling masonry, premature detonation of explosives, premature collapses of buildings, and falls.  If you or a loved one has been affected by a demolition accident, you have the right to seek compensation from the responsible parties. Call us at The Law Offices of Jonathan B. Nelson, PC. We will help you through the process of filing for compensation; guide you in receiving appropriate treatment for your injuries, and getting on with your life.

Dangerous and Defective Machines

No matter how trained and careful workers on construction sites prove to be, the use of dangerous and defective machines puts them at risk for a serious accident resulting in injury or death. Common accidents that occur from dangerous and defective machines include amputations, blindness, sprains, burns, broken bones, and traumatic brain injuries. These injuries can result from almost any kind of equipment with some of the most common being welding apparatuses, nail guns, and machine presses. Many workers often blame themselves for these accidents but later realize that the machine itself was at fault for the accident or the employer did not follow OSHA guidelines in providing a safe working environment.

Dangerous and defective machine cases can be very complicated. While workers who have been injured on the job can file for Workers Compensation benefits, these benefits do not take into account pain and suffering and are subject to a maximum amount. Those who experience pain and suffering usually must look to the courts for compensation. If you have been injured, it is imperative that you hire a construction accident lawyer who is familiar with OSHA regulations and has experience litigating product liability claims. Call us at The Law Offices of Jonathan B. Nelson, PC for a free no obligation case review.  We will make our experience work for you.

Compressed gas accidents

Many of the tools and machines used on construction sites need compressed gases to provide the power for operation. Workers who operate these machines, install the gases, or work near those that do either of these two tasks face major hazards.  The compressed gases used at construction sites are often poisonous, corrosive, inert, explosive, and flammable. The power inherent in a canister of compressed gas can turn it into a missile that can fly long distances and injure multiple people. Pressurized hoses, if improperly maintained or handled, can loosen spreading debris and poisonous gases/paint into the eyes of unwary workers.

The following are some other hazards associated with pressurized gases:

Asphyxiation – Colorless and inert gases can escape from storage containers and quickly reduce the oxygen in a worker’s enclosed area. Employers should provide their workers with oxygen monitoring equipment to prevent against this happening

Chemical Burns – Corrosive gases can escape from their containers, eat through a worker’s clothes (even if fire resistant) and cause severe burns. Certain non corrosive materials if mixed with a moist environment can unexpectedly become corrosive and cause severe injuries to an unknowing worker.

Back injuries and trauma – Compressed gas containers can be extremely heavy. A worker without a safety brace can easily hurt his or her back trying to move a compressed gas container. In addition, each year hundreds of workers are either injured or killed from falling compressed gas containers

Fire and Explosions – A leaking or cracked container can lead to the escape of gases that if exposed to a flame, can cause an explosion or fire.

There are strict federal, state, and local regulations on the books that are designed to protect workers against compressed gas accidents, whether they occur during use, storage, or transport. Unfortunately, employers often do not live up to their obligations to proactively provide a safe working environment for their workers. Time and time again, employers cut corners to save time and money. In these cases, the employee ultimately pays.

If you or a loved one has been injured in a compressed gas accident or you have lost a loved one in a fatal accident, call us at The Law Offices of Jonathan B. Nelson, PC. We will make sure that the responsible parties do not escape from compensating you for your injuries and loss.
